1. Introduction
These Terms & Conditions ("Terms") govern your use of the Bancroft Education website and the content, materials and services made available through it.
The website is operated by Bancroft Education Ltd ("Bancroft Education", "we", "us", "our"), a private limited company registered in England and Wales.
By accessing or using our website, you agree to comply with these Terms. If you do not agree with these Terms, you should not use the website.
Additional or separate terms may apply to particular products, services, promotions, platforms or purchases. Where this is the case, those terms will be made available at the relevant time.
2. About Bancroft Education
Bancroft Education creates and provides educational content and resources for learners, teachers and other users. These may include books, stories, activity materials, learning resources, audio content, videos, downloadable materials and other educational or media content.
Our registered company details are provided in Section 23 of these Terms and in the footer of this website.
3. Using Our Website
You may use our website for lawful personal, educational and professional purposes in accordance with these Terms.
You are responsible for ensuring that your use of the website complies with all laws and regulations that apply to you.
We may update, change, suspend, withdraw or restrict access to any part of the website where reasonably necessary, including for maintenance, security, technical, legal or operational reasons.
We do not guarantee that the website, or any particular part of it, will always be available or uninterrupted.
4. Use by Children and Young People
Our website and educational resources may be used by children and young people where appropriate.
Parents, guardians, teachers and other responsible adults should consider whether particular content, resources or activities are suitable for the age, ability and circumstances of the learner using them.
Where a feature or service requires parental or guardian involvement or consent, this will be stated at the relevant point.
Children and young people should not provide personal information through our website unless it is appropriate to do so and any consent or supervision required by applicable law has been provided.
5. Educational Content and CEFR Levels
Bancroft Education materials are designed to support language learning and education. Any references to CEFR levels, learning levels, difficulty, estimated study time, learning outcomes or similar educational classifications are provided as guidance.
Individual learners may find the same material easier or more difficult depending on their existing knowledge, learning experience, first language and other factors.
Unless we expressly state otherwise, using or completing a Bancroft Education book, resource, course or activity does not constitute an official language qualification, examination result or independent certification of a person's CEFR level.
Our resources are intended to support learning and teaching. Teachers, schools and other educational professionals remain responsible for deciding whether a particular resource is appropriate for their learners and circumstances.
6. Intellectual Property
Unless otherwise stated, the website and the content made available through it are owned by, licensed to, or otherwise lawfully used by Bancroft Education Ltd and are protected by applicable copyright, trade mark and other intellectual property laws.
This may include, without limitation, books, original stories, characters, written text, educational materials, worksheets, activities, illustrations, artwork, photographs, graphics, logos, branding, audio recordings, audiobooks, videos, downloadable files, page layouts and other content.
Accessing, downloading or using Bancroft Education content does not transfer ownership of that content or of any associated intellectual property rights to you.
Except where these Terms, a specific resource licence or applicable law permits otherwise, you must not reproduce, republish, distribute, sell, license, publicly upload, commercially exploit, modify or create derivative versions of our content without our prior permission.
Nothing in these Terms is intended to prevent uses that are expressly permitted by applicable copyright law.
7. Third-Party Intellectual Property
Trade marks, logos, product names, company names, images and other intellectual property belonging to third parties remain the property of their respective owners.
Their appearance on our website does not imply that Bancroft Education owns those rights or that the relevant third party sponsors, endorses or is affiliated with Bancroft Education unless this is expressly stated.
Where third-party content is used under licence, permission, an applicable legal exception or another lawful basis, the rights of the relevant owner remain unaffected.
8. Free Educational Resources and Classroom Use
Some Bancroft Education resources may be made available free of charge. A resource being free to access or download does not mean that it is free from copyright or other intellectual property rights.
Unless a particular resource states otherwise, free downloadable educational materials may be used for personal study and may be printed or shared by an individual teacher with students whom that teacher directly teaches.
This permission does not allow you to sell the materials, upload them to public websites or repositories, distribute them outside your own teaching context, remove copyright or branding notices, present them as your own work, or use them as part of a competing commercial product or service.
Schools, organisations, publishers, training providers and other institutions may be subject to additional licensing requirements where these are stated on the relevant resource or service.
9. Books, Stories, Audiobooks and Other Media
Books, stories, audiobooks, videos and other media made available by Bancroft Education are provided for the uses expressly stated on the relevant product or page and for any uses permitted by law.
The fact that an audiobook, video, story or other item is available to access without charge does not grant permission to reproduce, redistribute, republish, broadcast, sell or commercially exploit that content.
Where content is hosted on or delivered through a third-party platform, your use of that platform may also be subject to the third party's own terms and policies.
10. Feedback, Suggestions and Communications
If you send us feedback, suggestions, corrections, ideas or other communications relating to our website, products, services or resources, you remain responsible for the content you submit.
You must not submit material that is unlawful, abusive, defamatory, threatening, misleading, malicious, infringes the rights of another person, or contains malware or other harmful content.
We may consider and use feedback, suggestions and corrections to improve our products, services, resources and operations.
Providing feedback or suggestions does not give you ownership of any resulting Bancroft Education product, service, resource, development or other work. Unless separately agreed in writing, submitting feedback does not create an employment, partnership, agency, confidential, fiduciary or other contractual relationship between you and Bancroft Education.
11. Third-Party Websites, Platforms and Retailers
Our website may contain links to third-party websites, retailers, social media platforms, video or audio platforms, payment providers and other external services.
These links are provided for convenience or to allow users to access products, content or services. Bancroft Education does not control third-party websites and is not responsible for their availability, security, content, privacy practices or terms.
A link to a third-party website does not necessarily constitute an endorsement of all content, products, services or views associated with that website.
Where you purchase a Bancroft Education product from an external retailer or marketplace, the transaction, payment, delivery, cancellation and return arrangements may be governed by the terms and policies of that retailer or seller.
12. Purchases, Paid Products and Services
Where Bancroft Education offers products or services for direct purchase through our website, additional information and, where appropriate, specific terms of sale will be provided before you place an order.
These may include information about the product or service, pricing, payment, delivery or access, cancellation rights, digital content, refunds and any other information required by applicable law.
Nothing in these Terms limits or removes any consumer rights that cannot lawfully be excluded or restricted.
Where a product is purchased from a third-party retailer, marketplace or other external seller rather than directly from Bancroft Education, you should refer to that seller's terms, delivery arrangements and returns or refund policy.
13. Accuracy of Information
We take reasonable care when preparing and maintaining our website and educational materials. However, we do not guarantee that all information will always be complete, current or free from errors.
We may correct, revise, replace or update website content and educational materials where we identify errors, make improvements or otherwise consider changes appropriate.
Product descriptions, availability, release dates, prices and other information relating to third-party retailers or services may change independently of Bancroft Education.
14. Prohibited Uses
You must not misuse our website or content. In particular, you must not:
- use the website for unlawful, fraudulent or malicious purposes;
- attempt to gain unauthorised access to the website, its servers, systems or related services;
- introduce viruses, malware or other harmful technology;
- interfere with, damage, overload or disrupt the operation or security of the website;
- impersonate Bancroft Education or falsely suggest that you are officially associated with us;
- infringe our intellectual property rights or the rights of any third party;
- systematically copy, extract or redistribute substantial parts of our website or resources without permission; or
- use our content in an unauthorised commercial product, service, repository, publication or dataset.
We may block, restrict or terminate access to our website or services where we reasonably believe that a user has seriously or repeatedly breached these Terms, infringed our rights, threatened the security or proper operation of the website, or engaged in unlawful activity.
Any action we take under this section will be proportionate to the circumstances and will not affect rights or remedies that you may have under applicable law.
15. Automated Extraction, Scraping and Artificial Intelligence
Except where permitted by applicable law or with our prior permission, you must not use automated systems, bots, crawlers, scraping tools or similar technologies to reproduce, harvest or systematically extract substantial amounts of protected Bancroft Education content.
This includes automated extraction for unauthorised commercial reuse, the creation of datasets, the training or development of artificial intelligence or machine-learning systems, or the creation of products or services that reproduce or substitute for our protected content.
This section does not prohibit ordinary search-engine indexing, accessibility technologies, lawful research activities, or other uses that are authorised by us or expressly permitted by applicable law.
16. Links to Our Website
You may link to publicly accessible pages on our website in a lawful and fair manner, provided that the link does not falsely suggest an association, approval, sponsorship or endorsement by Bancroft Education.
You must not frame our website within another website or present Bancroft Education content in a misleading way without our permission.
We may request the removal of a link where we reasonably believe that it is misleading, unlawful, harmful to our rights or reputation, or otherwise inconsistent with these Terms.
17. Liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation and any other liability for which exclusion or limitation is prohibited by law.
Bancroft Education will not be responsible for loss or damage resulting from circumstances outside our reasonable control, or from the acts or omissions of third-party websites or services, where that loss or damage was not caused by a breach of these Terms, negligence or other wrongdoing by Bancroft Education.
We do not promise that access to our website will always be uninterrupted, secure or error-free. However, nothing in these Terms removes any responsibility we have where a failure on our part gives rise to a legal right or remedy that cannot lawfully be excluded.
If you use our website or resources for business or professional purposes, you are responsible for determining whether they are suitable for your particular requirements.
Nothing in this section affects any statutory rights or remedies available to consumers.
18. Privacy and Cookies
Our handling of personal information is explained in our Privacy Policy.
Information about cookies and similar technologies is available in our Cookie Policy.
Information relating to accessibility and safeguarding is available on our Accessibility & Safeguarding page.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes to our website, products, services, business practices, legal requirements or regulatory guidance.
The current version will be published on this page and the "Last updated" date at the top of the page will be changed accordingly.
Where a material change affects an existing contractual relationship with a customer, any additional notification or consent required by applicable law will be provided.
20. Severability
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary.
The remaining provisions of these Terms will continue in full force and effect.
21. No Waiver
If Bancroft Education does not immediately enforce a provision of these Terms or exercise a right or remedy available to us, this does not mean that we waive that provision, right or remedy.
22. Governing Law and Jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.
If you are using our website as a consumer, you may also be entitled to rely on mandatory protections provided by the law of the country in which you live and to bring proceedings in any courts available to you under applicable law.
Subject to those consumer rights and any other mandatory legal requirements, the courts of England and Wales will have jurisdiction in relation to disputes arising out of or in connection with these Terms.
